The Flex Trust
The FLexTrust is a Texas Revocable Living Trust that is designed to be completely anonymous.
FLEXIBLE
A revocable trust allows complete flexibility to modify, change or end the trust. The creators, (grantors or trustors) make an agreement with each other that is a legal document for a wide variety of purposes.
PRIVATE
All trust is a private document and not filed with any governmental agency. Therefore no one will know the identity of the creators. Privacy is critical because it allows individuals to own property and control it anonymously and therefore hidden from would be claimants – or anyone else!
PROBATE AVOIDANCE
Probate is the process of transferring property from a deceased person to another. The process is controlled by the state, can be expensive and time consuming. Most of all, probate is PUBLIC RECORD.
AVOID CHALLENGES
When a will is probated there is opportunity for beneficiaries to challenge the distribution and for heirs that are not included to challenge the validity of it. A FlexTrust passes property directly outside of probate foreclosing the opportunity for anyone to challenge its validity or language.
TAX NEUTRAL
Even though a trust is a separate legal entity, a revocable trust DOES NOT pay taxes, is not required to file a tax return and has no affect on the grantors’ taxes. It is 100% tax neutral.
THE FLEX TRUST LLC
This LLC is no ordinary LLC. Since it is formed by the FlexTrust, the identity of the creators is shielded from public disclosure.
PRIVACY
In Texas, the Secretary of State requires the identity of the incorporator and the registered agent. As long as this person is not the same as the owners, there is no way for anyone to discover who really controls the LLC
LAWSUIT AVOIDANCE
The less visable one’s assets and business dealings are, the less likely they are to be sued. Since the LLC owners’ names are unkown, someone would have to go to great lengths to make a claim against them.
COMPLETE ASSET PROTECTION
The asset protection of a Texas LLC works two ways. First it protects the managers and members personally from attack and second the assets inside the LLC are NOT available to creditors of the owners from suits unrelated to the activity of the LLC.
TAX NEUTRAL
If an LLC is owned by a trust as described here, or a single member (including a married couple), the LLC has no filing obilgations. All the tax reporting is done on the individuals’ tax returns as if the LLC was never formed.
